... According to Smith’s website, no additional cuts had to be made, so apparently they got by just on making a good argument for the parts that were  considered trouble. This is good news, of course, because while an NC-17 rating would have given the film some extra publicity, it would have cut down on the audience. Fourteen year olds can usually slip into an R movie but theaters might get nervous when they see the NC 17 rating and might worry about their own bad publicity if thirteen year old Madison comes home and tells Mom she just saw a movie called Zack and Miri Make ...

Well, Kevin Smith told me at Comic-Con that August 5 was the day he took his film ZACK AND MIRI MAKE A PORNO before the MPAA Appeals Board to try and knock down the film's current NC-17 rating to an R.
