In a shot across the bow, Mark Cuban, owner of the NBA team, the Dallas Mavericks lashed out at the SEC after it filed a civil complaint against him today for engaging in insider trading. The staff's process was result-oriented, facts be damned. The government's claims are false and they will be proven to be so. The Commission's claims are infected by the misconduct of the staff of its Enforcement Division." OK, let the games begin. Cuban has been fighting with the SEC for more than two years as he sought to keep them from charging him with insider trading. He is as furious about this as he generally is about the Mavericks losing. It is rare for a defendant in a government case to be this vituperative. Ex Dancing With the Stars Contestant Charged With Insider Trading

Billionaire Internet entrepreneur and onetime Dancing With The Stars contestant Mark Cuban has been charged with insider trading. The Securities Exchange Commission alleges that in June 2004, Mamma.com Inc. invited Cuban to participate in a confidential stock offering after he agreed to keep the information private. Less than four hours later, he learned the company was planning to raise money through a public offering and that the stock price was about to fall. To avoid losses in excess of $750,000, he allegedly instructed his broker to to sell all of his Mamma.com stock. "As we allege in the complaint, Mamma.com entrusted Mr. Cuban with nonpublic information after he promised to keep the information confidential," Scott W. Friestad, Deputy Director of the SEC's Division of Enforcement said in the report. Dancing pro Kym Johnson received medical attention for a shoulder injury, but a rep for ABC told Usmagazine.com on Monday that she will be performing on Monday night's show.
